It’s time for a legal minute with the professionals from Dietrich Law. An individual was injured during a fall resulting from ice not being cleared on municipal property. What should they do? And how long do they have to notify the municipality? A claim for a fall on a sidewalk or roadway results in a requirement to provide written notice of the time and place of the injury to the appropriate municipalities or the province within ten days. You may be badly injured enough to have a reasonable excuse to extend this deadline but the better idea is to get that notice in right away. If you don’t know whether you are on a city or regional or provincial road, then don’t take a chance. Contact a lawyer or ensure that notice is sent to all locations. If it was a sidewalk, the state of the sidewalk will be the key to determining liability and the standard is gross negligence. So always try to note any witnesses and get pictures of where you fell as soon as possible. There are strict limitation periods.
