It’s time for a legal minute with the professionals from Dietrich Law. Due to an injury, an individual may go on long term disability. Their insurance company denies their disability claim. What can a legal professional do to help? It’s complicated. There are a number of long term disability insurers and there are various types of disability insurance. When we meet with someone to evaluate their chances of succeeding with an appeal, we like to see the policy and any policy booklet, all the letters to and from the insurance company, and any medical information that was submitted. Each contract has its own tests to be met and requirements regarding treatment, pre-existing health conditions, and ongoing reports from the family doctor. All of this must be looked at in light of the contract and the state of the disability. Often the disability is caused by an injury that may result in a separate claim, which must be coordinated.
