It’s time for a legal minute with the professionals from Dietrich Law. A child sustains severe injuries from a dog bite. The dog was chained in the yard, but the child wandered too close. Who is at fault? The Ontario Dog Owner’s Liability Act sets out strict responsibility on the owner of the dog for any injury it causes. In this story, the child was in someone’s yard and came too close. That brings up questions of whether the dog was freely accessible to anyone passing by, and whether the dog was aggressive by nature – such as a guard dog, and requiring a warning to stay away. The parents – if they were supervising the child – may be subject to a claim for negligent supervision. Dog bites can often cause scarring and plastic surgeons will need to be consulted.
