Time now for a legal minute with the professionals from Dietrich Law. A working person with long-term health issues gets worse and has to stop working as their doctor determines they are disabled. They apply for, and receive, long-term disability benefits but then despite their doctor's support – they are cut off and still cannot work. What can they do? Long term disability insurance policies have complex rules for appealing decisions and the burden of paying for medical evidence is on you – the disabled person. Hiring a lawyer helps, but there is still some time before the case is resolved or brought to trial. CPP is available if you contributed sufficient premiums in four of the last six years, or three of six if you contributed a total of twenty-five years. You must also have a severe and prolonged disability that prevents you from engaging in any time of gainful or regular employment. If denied, there are three levels of appeal.
