It’s time for a legal minute with the professionals from Dietrich Law. Previously, we discussed a person involved in a vehicle collision that has developed chronic pain problems. With respect to our last question about chronic pain from a motor-vehicle accident, in this case the injured person was not to blame for the accident. That means the person who caused the accident must advice their insurer who will wait for a notice from the injured person and investigate the extent and nature of the injuries. Chronic pain is a terrible thing to experience and it is very difficult to cure. Often, it is never completely cured. To be eligible for pain and suffering compensation from a motor-vehicle accident, the chronic pain must result from the injuries in the accident and it must meet the Ontario Insurance Act threshold, which requires it to cause a serious and permanent impairment of an important physical, mental, or psychological function.
