Does legalization of cannabis affect the rights of the injured person? Strictly speaking: no. Legalization does not directly affect the rights of injured persons. The main issue is still the circumstances surrounding the accident and who caused it. Impaired drivers are a menace. While cannabis is becoming legalized for consumption, its use may impair a driver’s ability. Even if a driver found to be impaired is insured, the circumstances surrounding any criminal charges that may arise from the accident can cause delays for their insurer dealing with the claim. If the impaired driver doesn’t have insurance of their own, the insurance of the injured person or their vehicle will cover damages for pain and suffering, income losses, and care and treatment.
