You can’t save your friend or relative from being charged with an offence under the Highway Traffic Act or the Criminal Code. You won’t be able to save them from an increase in insurance rates. You need to consider whether you can live without treatment and compensation in order to recover from your injuries. Accessing benefits under the Ontario Car Insurance System is similar to using OHIP. If you were truthful and honest about your injuries and about how the accident happened, then there is no question about your right to compensation and treatment. That is my opinion, although I respect the opinion of others who disagree. Ultimately the choice is up to you. There are strict limitation periods.
